Sabivest's Terms of Use
Introduction
Welcome to Sabivest, a mobile application operated by Africa Prudential Plc (“Africa Prudential”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of the Sabivest mobile application, website, and related services (collectively, the “Platform”).
By accessing or using Sabivest, you agree to comply with and be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, please do not use the Platform.
Definitions
For the purpose of these Terms:
“App” or “Platform” means the Sabivest mobile application and related web services.
“User”, “You”, or “Your” means any person or entity who accesses or uses the Platform.
“Wallet” means the digital wallet feature within the App that allows users to fund, store, and use electronic value for transactions.
“Third-Party Service Providers” refers to external partners who provide payment, KYC, data processing, or investment services integrated within the Platform.
“Investment Products” refers to financial instruments or services accessible through the Platform.
Eligibility
You must be at least 18 years old and have the legal capacity to enter into binding agreements under Nigerian law. By using the Platform, you represent that all information provided during registration is true, accurate, and complete.
Account Registration
To use the Platform, you must create an account by providing accurate personal and contact information.
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Africa Prudential reserves the right to suspend or terminate accounts found to contain false or misleading information or engaged in unauthorized activity.
Use of the Platform
You agree to use Sabivest solely for lawful purposes and in accordance with these Terms.
You must not:
Use the Platform for fraudulent, unlawful, or abusive purposes.
Interfere with or disrupt the functionality or security of the Platform.
Attempt to gain unauthorized access to other users’ accounts or data.
Reproduce, distribute, or modify any part of the Platform without prior written consent from Africa Prudential.
Wallet Services
The Sabivest Wallet enables users to hold funds for transactions within the Platform.
Funds in your Wallet are stored with licensed financial partners.
You authorize Africa Prudential and its partners to process credits, debits, and transfers as instructed by you through the Platform.
Transaction fees, limits, and processing times are displayed within the App and may be updated periodically.
Funds credited into your investment wallet on the Platform are considered as received only when the transaction has been confirmed by our payment service providers and the corresponding value has been reflected in your wallet balance.
You acknowledge and agree that any funds deposited into your wallet are intended solely for the purpose of purchasing products or services offered on the Platform. Funds in your wallet cannot be withdrawn, transferred to third parties, or used outside the scope of the Platform’s offerings.
The wallet is not a general-purpose account or bank account and does not accrue interest. It functions solely as a means to facilitate transactions within the Platform.
The Platform shall not be responsible for any delays or failures in wallet crediting resulting from incorrect payment details, third-party processing delays, or network-related issues.
Users are responsible for ensuring the accuracy of deposit details and must retain proof of payment for any wallet funding activity.
In the event of any dispute regarding wallet balance or crediting, you agree to notify us within [30] days of the transaction and provide all necessary supporting documentation to facilitate resolution.
The Platform reserves the right to investigate, reverse, restrict, or freeze wallet transactions if fraud, error, or violation of these Terms is suspected.
Intellectual Property
All trademarks, content, design, software, and materials available on the Platform are owned or licensed by Africa Prudential.
Users are granted a limited, non-transferable, revocable license to use the Platform for personal, non-commercial purposes only.
You may not copy, modify, distribute, or create derivative works from the Platform’s content without prior written permission.
Limitation of Liability
To the fullest extent permitted by law, Africa Prudential shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of:
Investment losses;
Delays or failure in processing transactions;
Unauthorized access to your account;
Interruptions or errors on the Platform;
Actions or omissions of third-party service providers.
Indemnification
You agree to indemnify and hold harmless Africa Prudential, its officers, employees, and partners from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of the Platform.
Suspension and Termination
Africa Prudential may suspend, restrict, or terminate your access to the Platform if:
You breach these Terms;
You engage in fraudulent or suspicious activities;
Required by law or regulatory authorities.
Upon termination, any remaining wallet balance may be refunded in accordance with applicable laws and after settlement of outstanding obligations.
